August 20, 2013 – Treasury Designates Guatemalan Trafficker Allied with Los Zetas – Jairo Estuardo Orellana Morales

The U.S. Department of the Treasury today designated Jairo Estuardo Orellana Morales, a violent Guatemalan narcotics trafficker, as a Specially Designated Narcotics Trafficker (SDNT) pursuant to the Foreign Narcotics Kingpin Designation Act (Kingpin Act). Orellana Morales traffics cocaine through Guatemala on behalf of Los Zetas and has been implicated in several executions in Guatemala in support of his drug trafficking activities.

Orellana Morales is linked to Marta Julia Lorenzana Cordon, a member of the Lorenzana crime family, who was designated by Treasury pursuant to the Kingpin Act in November 2012. Today’s announcement is the latest in a series of efforts by the Treasury Department to thwart transnational drug cartels, such as Los Zetas, which are responsible for distributing significant amounts of cocaine, marijuana, and methamphetamine in the United States. President Obama identified Los Zetas as a significant foreign narcotics trafficker under the Kingpin Act in April 2009 and in July 2011, he named Los Zetas as a significant Transnational Criminal Organization in the Annex to Executive Order 13581 (Blocking Property of Transnational Criminal Organizations).

“Jairo Orellana Morales employs extreme violence in his efforts to traffic cocaine through Guatemala on behalf of Los Zetas,” said Treasury’s Director of the Office of Foreign Assets Control (OFAC) Adam J. Szubin. “OFAC will continue to deny Los Zetas and their Central American operatives access to the U.S. financial system.”

Today’s action prohibits U.S. persons from conducting financial or commercial transactions with Jairo Orellana Morales, and freezes any assets he may have under U.S. jurisdiction.

Internationally, OFAC has designated more than 1,300 businesses and individuals linked to 103 drug kingpins since June 2000. Penalties for violations of the Kingpin Act range from civil penalties of up to $1.075 million per violation to more severe criminal penalties. Criminal penalties for corporate officers may include up to 30 years in prison and fines of up to $5 million. Criminal fines for corporations may reach $10 million. Other individuals could face up to 10 years in prison and fines for criminal violation of the Kingpin Act pursuant to Title 18 of the United States Code.

OFAC Recent Sanctions

August 15, 2012 – Kingpin Act Designations​ – Treasury Applies Additional Sanctions to Guatemalan Drug Trafficking Operation

The U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) today announced the designation of two individuals and 24 entities with ties to previously-designated Guatemalan trafficker Marllory Dadiana Chacon Rossell or other designated individuals as Specially Designated Narcotics Traffickers (SDNTs). Today’s action, taken pursuant to the Foreign Narcotics Kingpin Designation Act (Kingpin Act), prohibits U.S. persons from conducting financial or commercial transactions with these entities and individuals and any assets the designees may have under U.S. jurisdiction are frozen.

The two individuals designated today are Guatemalan nationals Christina Stetanel Castellanos Chacon (a.k.a. Cristha Castellanos), who is Chacon Rossell’s daughter, and Maria Corina Saenz Lehnhoff (a.k.a. Maria Corina de Del Pinal). Both are responsible for laundering narcotics proceeds on behalf of Marllory Chacon Rossell. Among the 24 entities designated today are Auto Hotel Punto Cero, a hotel in Barberena, Guatemala; Sistemas Constructores, a construction company; Importadora Borrayo Lasmibat, an import-export company; Boutique Marllory, a clothing store and; Casa Vogue, a household items store.

“Targeting the corporate and financial network of Marllory Chacon and her associates is at the core of our efforts to degrade these dangerous drug trafficking organizations,” said OFAC Director Adam J. Szubin. “By designating additional elements of the Chacon Rossell network, OFAC continues to undermine the organization’s ability to launder narcotics proceeds.”

Marllory Dadiana Chacon Rossell leads a drug trafficking and money laundering organization based out of Guatemala with operations in Honduras and Panama that supplies Mexican drug cartels, including Los Zetas. OFAC designated Chacon Rossell as an SDNT in January 2012, along with three of her top associates, Jorge Andres Fernandez Carbajal, Hayron Eduardo Borrayo Lasmibat, and Mirza Silvana Hernandez De Borrayo, and four entities located in Guatemala and Panama. Chacon Rossell is responsible for transshipping thousands of kilograms of cocaine per month and is believed to launder tens of millions of U.S. dollars in narcotics proceeds each month.

OFAC coordinated with the Drug Enforcement Administration on this investigation. Today’s action is part of ongoing efforts pursuant to the Kingpin Act to apply financial measures against significant foreign narcotics traffickers and their organizations worldwide. The Treasury Department has designated more than 1,100 individuals and entities pursuant to the Kingpin Act since June 2000.

“DEA and the Treasury Department are attacking drug trafficking organizations at every level, using the law enforcement tools necessary to dismantle the financial networks of these dangerous criminal groups,” said DEA Chief of Financial Operations John Arvanitis. “This organization’s ability to launder drug trafficking proceeds will be severely hindered as a result of this designation.”

Penalties for violations of the Kingpin Act range from civil penalties of up to $1.075 million per violation to more severe criminal penalties. Criminal penalties for corporate officers may include up to 30 years in prison and fines up to $5 million. Criminal fines for corporations may reach $10 million. Other individuals face up to 10 years in prison and fines pursuant to Title 18 of the United States Code for criminal violations of the Kingpin Act.

Major drug-producing or drug-transit country

September 15, 2011 – Under the Foreign Relations Authorization Act (FAA), the President is required each year to notify Congress of those countries he determines to be major illicit drug-producing countries or major drug-transit countries that significantly affect the United States. A country’s presence on the list does not necessarily reflect its counternarcotics efforts or its level of cooperation on illegal drug control with the United States. The designation can reflect a combination of geographic, commercial, and economic factors that allow drugs to be produced and/or trafficked through a country.

When a country on the list does not fulfill its obligations under international counter-narcotics agreements and conventions, the President determines that the country has failed demonstrably to meet its counterdrug obligations, only Bolivia, Burma, and Venezuela, failed demonstrably. Such a designation can lead to sanctions. However, the President may also execute a waiver when he determines there is a vital national interest in continuing U.S. assistance. Even without such a waiver, humanitarian assistance and counternarcotics assistance may continue.

TCO

July 25, 2011 – President Obama has signed an Executive Order imposing sanctions against significant transnational criminal organizations (TCO’s). The Order provides the United States with new tools to break the economic power of transnational organized crime and protect financial markets. It will assist the Administration’s efforts to disrupt, dismantle and defeat the TCO’s that pose a significant threat to U.S. national security, foreign policy or the economy.

As a result of this Order, any property in the United States or in the possession or control of U.S. persons in which the significant TCO’s listed in the Annex have an interest is blocked, and U.S. persons are prohibited from engaging in transactions with them.

The Order also authorizes the U.S. Department of the Treasury, in consultation with the Departments of Justice and State, to identify for sanctions any individual or entity determined to have materially assisted, sponsored or provided financial, material or technological support for any person whose property and interests in property are blocked pursuant to this Order.

The US encourage partners and allies to echo the commitment and join in building a new framework for international cooperation to protect all our citizens from the violence, harm and exploitation wrought by transnational organized crime.

In signing today’s Order, the President imposed sanctions on the following organizations listed:

June 05, 2013 – Transnational Criminal Organizations Designations – Mara Salvatrucha Leaders aka MS13

The Mara Salvatrucha gang originated in Los Angeles and has spread to Central America, other parts of the United States, and Canada. It is commonly abbreviated as MS, Mara, and MS-13. There is some dispute about the etymology of the name. The most common belief is that the word “Mara” refers to the Spanish word for “gang”, and “Salvatrucha” (which is Spanish slang) for “Salvadoran army ant”. Alternatively, it is suggested that “Salvatrucha” refers to the Salvadoran peasant guerrillas, the source of much of the gang’s early manpower. The number 13 is homage to the Los Angeles gang “Los Emes” or “The Ms”(M being the thirteenth letter of the alphabet). The gang was set up in Los Angeles in 1980’s by Salvadoran immigrants in the city’s Pico-Union neighborhood. Source: Urban Dictionary

OECD Tax Haven

Jurisdiction that have committed to the internationally agreed tax standard, but have not yet substantially implemented. Still considered to be a Tax Haven.

The internationally agreed tax standard, which was developed by the OECD in co-operation with non-OECD countries and which was endorsed by G20 Finance Ministers at their Berlin Meeting in 2004 and by the UN Committee of Experts on International Cooperation in Tax Matters at its October 2008 Meeting, requires exchange of information on request in all tax matters for the administration and enforcement of domestic tax law without regard to a domestic tax interest requirement or bank secrecy for tax purposes. It also provides for extensive safeguards to protect the confidentiality of the information exchanged.
